Terms & Conditions

Welcome to www.nogso.top (the “Website”). The Website is operated by Hong Kong Nongso Trading Co., Limited, a limited company incorporated in the Hong Kong Special Administrative Region (“we”, “us” or “our”). These Terms and Conditions (the “Terms”) apply to your access to and use of the Website and to any purchase you make through it.

Please read these Terms carefully before browsing the Website or placing an order. By accessing or using the Website, or by placing an order, you agree to be bound by these Terms and by the policies they refer to: our Privacy Policy, Delivery Information and Return Policy. If you do not agree to these Terms, please do not use the Website.

1. Changes to these Terms

We may update these Terms from time to time. Updated Terms will be published on this page with their effective date. By continuing to use the Website after an update, you accept the updated Terms. Each order is governed by the version of the Terms in effect when that order was placed.

2. Eligibility

  • You confirm that you are at least 18 years old, or have reached the age of majority where you live. Minors may only use the Website with the consent and supervision of a parent or guardian.
  • You must not use the Website or our products for any unlawful or unauthorised purpose, or break any law in your jurisdiction (including copyright laws) when using the Website.

3. Your account

  • When you register an account, you must provide true, accurate and complete information and keep it up to date.
  • You are responsible for keeping your password secure and for all activity under your account. Please contact us immediately if you believe your account has been used without your permission.
  • We may suspend or close your account if you breach these Terms.

4. Product information

  • We make every effort to display product colours, images, sizes and descriptions accurately. Because screens and lighting vary, the actual colour of a product may differ slightly from what you see.
  • Garment measurements are taken by hand with the item laid flat and may vary by 1–3 cm. Please check the size information on the product page before ordering.
  • Stock is limited. We may limit the quantity purchased per customer, per household or per order, and may discontinue any product at any time.

5. Prices and payment

  • The price you pay is the price shown on the Website when you place your order. Prices can be displayed in HKD, USD or EUR. Unless stated otherwise at checkout, prices do not include any import duties or taxes.
  • We may change prices at any time, but changes will not affect orders that have already been paid for.
  • If a price or product description is clearly wrong because of an error, we may cancel the affected order before it ships and give you a full refund. We will let you know by email.
  • Payments are processed by third-party payment service providers over encrypted connections. We do not store your full card number on our servers.
  • You confirm that you are authorised to use the payment method you provide. If a transaction appears fraudulent, we may hold the order and ask you for verification.

6. Orders and cancellations

  • The order confirmation email you receive after checkout means we have received your order; it does not mean we have accepted it. A contract between you and us is formed when we send you a shipping confirmation email.
  • We may refuse or cancel an order if: the product is out of stock; there is an error in the price or product information; we cannot deliver to your address; payment fails or the order appears fraudulent; or the order appears to be placed for resale. If we cancel an order, we will refund everything you paid.
  • You can cancel your order for a full refund by contacting us before it ships. Once an order has shipped, it can no longer be cancelled, but you may request a return under our Return Policy.

7. Delivery

Processing times, shipping fees, customs duties and lost-parcel claims are explained in our Delivery Information. Risk of loss or damage to the products passes to you when they are delivered to you or to the recipient you nominate.

8. Returns and refunds

Return conditions, time limits and the refund process are set out in our Return Policy. Nothing in these Terms or in the Return Policy affects your statutory rights as a consumer under applicable law.

9. Discount codes and promotions

  • Discount codes and promotions are subject to their own terms. Unless stated otherwise, each code may be used once per customer (identified by account, email address, shipping address or payment method), has no cash value and cannot be combined with other offers.
  • We may cancel a discount or an order if we detect multiple sign-ups, false information or other misuse of a promotion.

10. Intellectual property

All content on the Website, including text, images, product photos, logos and page design, is owned by us or the relevant rights holders and is protected by intellectual property laws. You must not copy, modify, distribute, sell or otherwise use any of it, or use it for any commercial purpose, without our prior written permission.

11. Reviews and submissions

  • By sending us reviews, comments, suggestions or other material through the Website, by email or otherwise (“Submissions”), you grant us a non-exclusive, royalty-free, worldwide licence to use, edit, copy, publish and translate them. We are not obliged to keep Submissions confidential, pay for them or respond to them.
  • You confirm that your Submissions do not infringe anyone’s rights, do not contain unlawful, defamatory, obscene or abusive material or malicious code, and that you will not use a false email address or impersonate anyone.
  • We may, but are not obliged to, review, edit or remove content that breaches these Terms or that we consider inappropriate.

12. Third-party services and links

The Website may link to third-party websites or use services provided by third parties, such as payment processing and parcel tracking. These are governed by the third party’s own terms and policies, and we are not responsible for their content, products or services. Please review their terms before using them.

13. Prohibited uses

When using the Website, you must not: (a) carry out, or encourage others to carry out, any unlawful activity; (b) infringe our intellectual property rights or those of others; (c) harass, abuse, defame, threaten or discriminate against anyone on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (d) submit false or misleading information; (e) upload or transmit viruses or any other malicious code; (f) collect or track the personal information of others; (g) spam, phish, scrape or crawl the Website; or (h) interfere with or circumvent the Website’s security features. We may end your use of the Website if you do any of these things.

14. Personal information

We handle your personal information in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and other applicable data protection laws. Please see our Privacy Policy for details.

15. Disclaimer

  • Information on the Website is provided for general reference. We work to keep it accurate, but it may occasionally contain typographical errors, inaccuracies or omissions. We may correct these at any time, including after you have placed an order, and may cancel the order where necessary.
  • We do not guarantee that the Website will be uninterrupted, error-free or completely secure, and we may suspend all or part of it for maintenance or other reasons.
  • To the fullest extent permitted by applicable law, and except for the commitments expressly made in these Terms, on product pages and in our policies, the Website and its services are provided “as is”.

16. Limitation of liability

  • To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special or consequential loss (including loss of profits or data) arising from your use of the Website or the products you buy.
  • To the fullest extent permitted by applicable law, our total liability in connection with any order is limited to the amount you actually paid for that order.
  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence or for fraud, or affects your statutory rights under the Sale of Goods Ordinance (Cap. 26) and the Control of Exemption Clauses Ordinance (Cap. 71) of Hong Kong, or under the consumer protection laws of your place of residence.

17. Indemnity

You agree to compensate us and our directors, employees and agents for losses and reasonable costs (including reasonable legal fees) arising from any third-party claim caused by your breach of these Terms, your breach of any law or your infringement of a third party’s rights.

18. Events beyond our control

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, government action, war, strikes, carrier or customs delays and internet outages. If such an event occurs, we will notify you as soon as possible and take reasonable steps to minimise the impact on you.

19. Termination

You may stop using the Website at any time, or contact us to close your account. If you breach these Terms, we may end your access to the Website without prior notice. Obligations and liabilities that arose before termination, including any amounts owed, continue after termination.

20. General

  • Severability: if any provision of these Terms is found to be unlawful, void or unenforceable, it will still apply to the fullest extent permitted by law, and the remaining provisions will not be affected.
  • No waiver: if we do not exercise or enforce any right under these Terms, that does not mean we have waived it.
  • Entire agreement: these Terms and the policies they refer to form the entire agreement between you and us regarding your use of the Website, and replace any earlier oral or written arrangements.
  • Headings: headings are for convenience only and do not affect how these Terms are interpreted.
  • Language: these Terms are published in English and Chinese. If the two versions differ, the English version prevails.

21. Governing law and disputes

These Terms are governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. If a dispute arises, please contact us first and we will try to resolve it with you amicably. If it cannot be resolved, both parties submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region. If you are a consumer, these Terms do not deprive you of the protection of mandatory provisions of the law of the country where you normally live.
